The pro-Russian and pro-European forces in parliament unexpectedly united with each other and with the president to remove the country&#8217;s main oligarch from power. But the latter decided not to surrender and, with the help of the Constitutional Court, \u201cdismissed\u201d the rioters. Now both sides claim legitimate authority.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p><a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;rurl=translate.google.com&amp;sl=auto&amp;sp=nmt4&amp;tl=en&amp;u=https:\/\/www.zdg.md\/ru\/%3Fp%3D27684&amp;xid=17259,15700021,15700186,15700190,15700256,15700259&amp;usg=ALkJrhh7ypcqByIpERw52Lj6Maqawd-FcQ\">Street protests began<\/a>&nbsp;in support of both sides of the conflict. So what actually happened in Chisinau?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Moldovan revolt: key facts<\/strong><\/h3>\n\n\n\n<p><em><strong>Starting Point: Parliamentary Elections and Coalition Disputes<\/strong><\/em><\/p>\n\n\n\n<p>According to the results of the elections on February 24, seats in the new parliament turned out to be almost equally divided between the three main political forces \u2013 the pro-Russian Socialist Party, the pro-European ACUM bloc and the Democratic Party of Moldova under the leadership of&nbsp;<a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;rurl=translate.google.com&amp;sl=auto&amp;sp=nmt4&amp;tl=en&amp;u=https:\/\/www.zdg.md\/ru\/%3Fp%3D25353&amp;xid=17259,15700021,15700186,15700190,15700256,15700259&amp;usg=ALkJrhiiVrm_ZAMVVcyNi6NNX9cb0-RjLA\">the country&#8217;s richest man, Vlad Plahotniuc<\/a>. Moldova is a parliamentary republic, so the winners were to form a coalition and determine the composition of the new government. Negotiations went on for more than three months, but a failure to find a resolution was the outcome.<\/p>\n\n\n\n<p>Plahotniuc proposed the ACUM bloc to unite, but each time, was refused:&nbsp;<em>\u201cThe ACUM bloc will not participate in any consultations with the current leadership of the PDM, since this clan is responsible for seizing the state, for isolating the country from the outside and undermining the economy due to the questionable seizure of the most important of economic assets, for poverty and for the expulsion of people from the country,\u201d<\/em>&nbsp;<a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;rurl=translate.google.com&amp;sl=auto&amp;sp=nmt4&amp;tl=en&amp;u=https:\/\/www.zdg.md\/ru\/%3Fp%3D25814&amp;xid=17259,15700021,15700186,15700190,15700256,15700259&amp;usg=ALkJrhgDb4Wx5Zoe3-ryT6ZOW-BuNQQ43Q\">one of the leaders of ACUM, Andrei N\u0103stase, justifies his position<\/a>.<\/p>\n\n\n\n<p><em><strong>Catalyst: Constitutional Court and Dissolution of Parliament<\/strong><\/em><\/p>\n\n\n\n<p>According to the law, the newly elected Moldovan Parliament is given a certain amount of time to approve the new government. If it fails to, the president can dissolve it and call for new elections. The deadline for the formation of the government caused controversy in the country. However, on June 7, the Constitutional Court suddenly ruled that the new government must be formed on June 8, stressing that the president should dissolve the \u201cfailed\u201d parliament.<\/p>\n\n\n\n<p><em><strong>Conflict: new government approved contrary to Constitutional Court decision<\/strong><\/em><\/p>\n\n\n\n<p>Under the threat of the dissolution of parliament, opposition forces in the Socialist Party and the pro-European bloc ACUM, signed a temporary coalition agreement on the morning of June 8. They were supported by President Igor Dodon. Indignant MPs gathered for an emergency meeting in a darkened session hall. The lights did not work and the service personnel neither came to work nor answered calls. Shortly after, the parliament officially proclaimed Moldova, &#8220;a captured state,&#8221; where, according to the MPs, all key state structures, including the Constitutional Court, are now under the control of Vlad Plahotniuc, the country&#8217;s biggest oligarch and leader of the ruling Democratic Party.<\/p>\n\n\n\n<figure><iframe allowfullscreen=\"\" src=\"https:\/\/cdn.iframe.ly\/api\/iframe?url=https%3A%2F%2Fwww.facebook.com%2Fnewsmakermd%2Fvideos%2F1336264183197364%2F%3Ft%3D0&amp;key=c06e5a774d4cfbe1376d6ba3e8989855&amp;v=1&amp;app=1\"><\/iframe><\/figure>\n\n\n\n<p>Socialist representative, Zinaida Greceanii, was then elected Speaker of Parliament. After which, President Dodon, who stayed with the MPs, nominated ACUM leader Maia Sandu as Prime Minister, and the Parliament approved her appointment together with the new government. For the first time in the history of the country, both the speaker and the prime minister as well as half of the Cabinet, are women.<\/p>\n\n\n\n<p><em><strong>The retaliatory strike: the Constitutional Court itself dissolves the parliament and abolishes the president<\/strong><\/em><\/p>\n\n\n\n<p>But on the night of June 9, at the request of MPs from the Democratic Party of the oligarch, Plahotniuc, the&nbsp;<a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;rurl=translate.google.com&amp;sl=auto&amp;sp=nmt4&amp;tl=en&amp;u=https:\/\/www.zdg.md\/ru\/%3Fp%3D27663&amp;xid=17259,15700021,15700186,15700190,15700256,15700259&amp;usg=ALkJrhjCkAYdnLfFN6XNf7yxxo-e_kVTgw\">Constitutional Court issues a new verdict<\/a>: the decisions taken by the MPs on June 8 would not be valid, because the deadline for forming functional parliamentary bodies expired on the evening of June 7. The Constitutional Court temporarily removed President Dodon (something that ha<a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;rurl=translate.google.com&amp;sl=auto&amp;sp=nmt4&amp;tl=en&amp;u=https:\/\/www.zdg.md\/ru\/%3Fp%3D23157&amp;xid=17259,15700021,15700186,15700190,15700256,15700259&amp;usg=ALkJrhg9VDzhRky0wmwyUHTyImOdtpT6Fg\">s already happened more than once<\/a>&nbsp;before, although it was previously the parliament that opposed Dodon) and appointed Pavel Filip, Sandu&#8217;s predecessor and the closest ally of Plahotniuc, acting president.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/s3-eu-central-1.amazonaws.com\/hromadske-en\/pictures\/files\/000\/003\/924\/original\/492a8350597d3d01617d701b90067541.jpg?1560273677\" alt=\"\"\/><\/figure>\n\n\n\n<h6 class=\"wp-block-heading\">Photo: ZDG<\/h6>\n\n\n\n<p>He immediately&nbsp;<a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;rurl=translate.google.com&amp;sl=auto&amp;sp=nmt4&amp;tl=en&amp;u=https:\/\/www.zdg.md\/ru\/%3Fp%3D27675&amp;xid=17259,15700021,15700186,15700190,15700256,15700259&amp;usg=ALkJrhhDFvjjnBLg3E-rJul_0tX2-bTsrw\">dissolved the \u201crebellious\u201d parliament and called for early elections<\/a>&nbsp;on September 6, 2019. The \u201canti-oligarchic\u201d parliament and the prime minister ignored the decision and continued to work through the evening of June 9. Meanwhile, on the streets, rallies began in support of both the parliament and the Democratic Party.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What power is &#8220;more legitimate&#8221;?<\/strong><\/h3>\n\n\n\n<p><em>\u201cAttempts to seize power and a coup,\u201d<\/em>&nbsp;\u2013 the head of the Democratic Party and oligarch Plahotniuc,&nbsp;<a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;rurl=translate.google.com&amp;sl=auto&amp;sp=nmt4&amp;tl=en&amp;u=http:\/\/newsmaker.md\/rus\/novosti\/plahotnyuk-obvinil-dodona-i-acum-v-gosperevorote-u-grazhdan-moldovy-bolshe-net-leg-44023&amp;xid=17259,15700021,15700186,15700190,15700256,15700259&amp;usg=ALkJrhgj3rETh2jBd4vzwZqXUTgCaYH_Tg\">described the events of the<\/a>&nbsp;weekend:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>The PDM does not recognize the plenary session and everything the MPs voted for today. We will take all legal and democratic actions so that the plan to seize state institutions is not implemented.<\/em><\/p><\/blockquote>\n\n\n\n<p>But many MPs and lawyers believe that the Constitutional Court made a mistake in the dates: the Constitution assigns three calendar months to the creation of the government, not 90 days \u2013 that is, by June 8 \u2013 the Parliament had one more day. Moreover, according to&nbsp;<a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;rurl=translate.google.com&amp;sl=auto&amp;sp=nmt4&amp;tl=en&amp;u=https:\/\/www.zdg.md\/ru\/%3Fp%3D27582&amp;xid=17259,15700021,15700186,15700190,15700256,15700259&amp;usg=ALkJrhg60pX6Cqfz8lHtVFKmlj1AWlr7NA\">Dodon himself<\/a>, the basic law states that only the president can dissolve the parliament. Besides, he is able to, but he is not obliged to do so. Therefore the positions of the security forces and the international community can be key in determining legitimacy. The Constitutional Court showed an example of an unprecedented lack of independence,\u201d<\/em>&nbsp;said Rebecca Harms, head of the European Parliament\u2019s parliamentary cooperation group with Eastern Partnership countries.<\/p>\n\n\n\n<p>Against the background of growing foreign support, parliamentarians&nbsp;<a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;rurl=translate.google.com&amp;sl=auto&amp;sp=nmt4&amp;tl=en&amp;u=http:\/\/newsmaker.md\/rus\/novosti\/resheniya-konstitutsionnogo-suda-moldovy-osporyat-v-espch-v-administratsii-prezide-44026&amp;xid=17259,15700021,15700186,15700190,15700256,15700259&amp;usg=ALkJrhhpHA7HN0MmSNEHF9T5cBvneQ51MQ\">appealed to the European Court of Human Rights<\/a>&nbsp;against the decisions of the Constitutional Court and the UN Security Council with a request to assess the situation in Moldova. Now both the head of the Democratic Party Plahotniuc, and the&nbsp;<a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;rurl=translate.google.com&amp;sl=auto&amp;sp=nmt4&amp;tl=en&amp;u=http:\/\/newsmaker.md\/rus\/novosti\/sandu-prizvala-politsiyu-ne-podchinyatsya-dempartii-44044&amp;xid=17259,15700021,15700186,15700190,15700256,15700259&amp;usg=ALkJrhhqIBUv6ZiE8EfG9MyGC3igCV0SPw\">newly appointed prime minister Sandu are<\/a>&nbsp;calling on the country&#8217;s security forces to obey the orders of the legitimate authority.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Note to Moldova&#8217;s neighbors<\/strong><\/h3>\n\n\n\n<p>Since independence was declared in 1991, Moldova experienced two major political crises, resulting in the change of power \u2013 the Twitter Revolution of 2009 against electoral fraud, which led to the fall of the Communist Party government, and the protests of 2015-2016 following the \u201cdisappearance\u201d<a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;rurl=translate.google.com&amp;sl=auto&amp;sp=nmt4&amp;tl=en&amp;u=https:\/\/www.facebook.com\/watch\/%3Fv%3D739377109591291&amp;xid=17259,15700021,15700186,15700190,15700256,15700259&amp;usg=ALkJrhi0zYRn73QUDkYuNRMjqYosEjmn-w\">&nbsp;of $1 billion<\/a>&nbsp;from three Moldovan banks. No matter how the current confrontation in Moldova ends, it is obvious that this is the first attempt in the history of the region to remove oligarchs from power with the help of a constitutional mechanism. \u201cCaptured State\u201d is an academic term that has recently been expanded to politically characterize democracies (especially in Eastern Europe), where, despite free elections, all key decisions, institutions of government and the media are controlled by one or several oligarchs. Moldovan MPs for the first time turned this term into legislative reality and tried to implement a legal &#8220;deoligarchization&#8221; of the country.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Events in Moldova: Citations<\/strong><\/h3>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>Today we have no East or West, no red, yellow or white.
