{"id":5725,"date":"2020-12-07T21:25:20","date_gmt":"2020-12-07T19:25:20","guid":{"rendered":"https:\/\/www.zdg.md\/en\/?p=5725"},"modified":"2020-12-08T11:56:22","modified_gmt":"2020-12-08T09:56:22","slug":"the-constitutional-court-suspended-the-socialist-shor-partys-bill","status":"publish","type":"post","link":"https:\/\/www.zdg.md\/en\/the-constitutional-court-suspended-the-socialist-shor-partys-bill\/","title":{"rendered":"The Constitutional Court Suspended the Socialist &#8211; Shor Party&#8217;s Draft Law"},"content":{"rendered":"\n<div class=\"wp-block-advanced-gutenberg-blocks-intro\"><p class=\"wp-block-advanced-gutenberg-blocks-intro__content\">The Constitutional Court suspended the Parliament&#8217;s decision to pass the Security and Intelligence Service from the President\u2019s subordination to that of the Parliament.<\/p><\/div>\n\n\n\n<p>The majority of the Court&#8217;s judges voted for the decision, while Vladimir \u021aurcan, the judge proposed by the Socialist Party to the Constitutional Court, did not vote.<\/p>\n\n\n\n<p>The judges&#8217; decision is based on a notification submitted by the Action and Solidarity Party deputy, Sergiu Litvinenco, who asked the Court to verify the constitutionality of these changes made last Thursday by the Socialists Party deputies, Pentru Moldova, and the Shor Party factions.<\/p>\n\n\n\n<p>The Court&#8217;s decision is final and the suspension of the amendments is valid until a firm solution of the case.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Last week, the Socialist and Shor Parties&#8217; deputies registered a\u00a0<strong>draft law for the Parliament to coordinate the Intelligence and Security Service\u2019s activity from the head of state.\u00a0<\/strong>Simultaneously, the same draft law authors voted in June 2019 for the President to lead the Security Service\u2019s activity, when Igor Dodon was the country\u2019s leader. Following Igor Dodon\u2019s loss in the presidential election, the Socialists re-elected the incumbent president as head of the Socialists\u2019 political Party.<\/p>\n\n\n\n<p>In June 2019, most parliamentarians voted for a draft decision by which the Intelligence and Security Service (SIS) came under the subordination of the country\u2019s president. However, the Parliament still controlled the institution. The 2019-approved project stipulates that the Parliament approves and dismisses the Security Service\u2019s director at the President\u2019s recommendation. The head of state coordinates the institution\u2019s activity within his\/her competence, being subject to parliamentary control.<\/p>\n\n\n\n<p>Maia Sandu <a href=\"https:\/\/www.zdg.md\/en\/?p=5642\" data-type=\"URL\" data-id=\"https:\/\/www.zdg.md\/en\/?p=5642\" target=\"_blank\" rel=\"noreferrer noopener\">described the attempt of the Socialists Party and Shor Party<\/a> to remove the Security and Intelligence Service (SIS) from the president\u2019s subordination as \u201can attempt to usurp the state power,\u201d set up by \u201cthe person who lost the elections and the trust of the people.\u201d<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The majority of the Court&#8217;s judges voted for the decision, while Vladimir \u021aurcan, the judge proposed by the Socialist Party to the Constitutional Court, did not vote.
