{"id":1295,"date":"2019-08-19T02:11:16","date_gmt":"2019-08-19T00:11:16","guid":{"rendered":"http:\/\/zdg.md\/eng\/?p=1295"},"modified":"2019-08-19T02:11:18","modified_gmt":"2019-08-19T00:11:18","slug":"chisinau-court-of-appeal-forces-fly-one-to-pay-state-budget-debt","status":"publish","type":"post","link":"https:\/\/www.zdg.md\/en\/chisinau-court-of-appeal-forces-fly-one-to-pay-state-budget-debt\/","title":{"rendered":"Chi\u0219in\u0103u Court of Appeal Forces Fly One to Pay State Budget Debt"},"content":{"rendered":"\n<p><strong>The Moldovan airline company Fly One has been ordered to pay 521,382 euros (10.2 million lei) to the state budget following the Chi\u0219in\u0103u Court of Appeal\u2019s decision to overturn the record on appeal the company made at the Chi\u0219in\u0103u Court (Centru) on March 19, 2019.<\/strong><\/p>\n\n\n\n<p>The Chi\u0219in\u0103u Court has ordered Fly One to repay debts to the state budget in accordance with the December 22, 2017 cession debt contract #3\/17. The decision \u2013 made on March 19, 2019 \u2013 comes in response to a lawsuit filed by Moldova\u2019s Civil Aviation Authority. The total to be repaid includes debt amounting 372,723 euros (7,273,541 lei), 68,693 euros (1,340,523 lei) in late interest and 84,422 euros (1,647,457 lei) in penalties.&nbsp;<\/p>\n\n\n\n<p>In addition, Fly One was ordered to pay a total 2,562 euros (50,000 lei) in taxes to the state budget.&nbsp;<\/p>\n\n\n\n<p>On May 28, 2019 the Chi\u0219in\u0103u Court of Appeal issued a mandatory injunction that gave the company ten days to submit a reasoned record on appeal and provide evidence of payment of 1,922 euros (37 500 lei) in state taxes.&nbsp;<\/p>\n\n\n\n<p><em>\u201cThe appellant did not present the proof of payment of the state tax and the record on appeal made in accordance with the requirements of the Law within the deadline established by the court. The company knew that it has to pay its debts to the state, as indicated above and it also had sufficient time. The Court established with certainty that the appellant did not remove the shortcomings within the offered deadline. [The Court] decided to overturn the record on appeal with all the annexed documents,\u201d <\/em>the Chi\u0219in\u0103u Court of Appeal said on the topic of its decision to overturn Fly One\u2019s Chi\u0219in\u0103u Court appeal from March 19, 2019.&nbsp;<\/p>\n\n\n\n<p>Fly One was founded in September 2015 by three people, including Maria Cebotari, the wife of former Minister of Justice, Vladimir Cebotari. The company is managed by Mircea Maleca, former director of the Civil Aviation Authority and former director of the Air Moldova Company.<\/p>\n\n\n\n<p>The low-cost airline company experienced rapid development. In April 2016, the company operated its first charter flights and in June launched the first regular passenger flight to Moscow.
