The re-elected President of the Constitutional Court (CC) Domnica Manole came out on Friday, November 10, with a statement in connection with her election to the post, in which she stresses that her “professional principles remain the same”.<\/strong><\/p>\n\n\n\n

“Today, by a majority vote, my colleagues elected me as President and I thank them for their trust.<\/p>\n\n\n\n

The Constitutional Court is an authority of jurisdiction designed to guarantee the functioning of the powers of the state and respect for human rights and freedoms in accordance with the Constitution.<\/p>\n\n\n\n

I would like to stress, in particular, that my professional principles remain the same.I will continue my efforts to strengthen the independence of the Constitutional Court, to increase the quality of judicial acts issued by the Court, to examine cases in strict compliance with the provisions of the Constitution, with the case law of the ECtHR, of other judicial institutions of the European Union and in the spirit of democracy and the rule of law. Together with colleagues, we will also continue to ensure the principle of transparency in the work of the Court.<\/p>\n\n\n\n

These are principles without whose observance the constitutional courts lose their legitimacy, and their image as effective guardians of fundamental rights is also affected”, reads the statement published on the Constitutional Court’s website.<\/p>\n<\/blockquote>\n\n\n\n

Domnica Manole was re-elected President of the Constitutional Court on Friday 10 November.<\/p>\n\n\n\n

“Today, 10 November, Judge Domnica Manole was elected as President of the Constitutional Court by a majority of votes,” reads an announcement published by the institution.<\/p>\n<\/blockquote>\n\n\n\n

Nicolae Ro\u0219ca resigned as President of the Constitutional Court on Thursday 9 November for “personal reasons”, according to Judge Domnica Manole.<\/p>\n\n\n\n

Contacted by ZdG, Manole said that Nicolae Rosca had announced his fellow judges also on Thursday, “at the end of the day”, and that “they were taken by surprise”.<\/p>\n\n\n\n

The public announcement of Nicolae Rosca’s resignation<\/a> was made on the institution’s website. The magistrate served as president for about half a year after Domnica Manole’s term expired.<\/p>\n\n\n\n

The announcement of Rosca’s resignation came hours after the court partially accepted a petition by lawyers for former Prosecutor General Alexandr Stoianoglo<\/a> and declared unconstitutional the article in the Law on the Prosecutor’s Office that provides for the evaluation of the Prosecutor General’s performance, as it stood before the entry into force of Law No 280 of 6 October 2022.<\/p>\n\n\n\n
